Fujifilm Business Innovation respects and protects your privacy

We always respect and commit to protecting your privacy. Therefore, we have established this privacy policy to regulate our collection, use and protection of your personal data.

This Policy also outlines your rights regarding personal data protection. More specific information about your rights and obligations is available in the Section 6 Your Rights and Obligations.

We may also provide additional information to you as we collect your personal data, and where we consider it’s useful to provide the information in an appropriate and timely manner.

1. Personal Data Definition

In this Policy, “Personal data” shall mean electronic information in the form of symbols, letters, numbers, images, sounds, or equivalences associated with an individual or used to identify an individual. The personal data includes (i) basic personal data and (ii) sensitive personal data as regulated by legal regulations, which can be listed (but not limited) to the below:

1.1. Basic personal data

  • (i) Surname, middle name and first name on birth record, another name (if any)
  • (ii) Date, month, and year of birth; date, month and year of death or missing
  • (iii) Gender
  • (iv) Place of birth, place of birth registration; permanent residence address; temporary residence address; current address; hometown; contact address
  • (v) Nationality
  • (vi) Personal image
  • (vii) Phone number, identification number; passport number; driver license number; vehicle plate number; personal tax number; social insurance number; medical insurance number
  • (viii) Marriage condition
  • (ix) Family relationship (parents, children)
  • (x) Personal digital account information; personal data reflecting activities and history of activities in cyberspace
  • (xi) Other personal data (that is not sensitive personal data)

1.2. Sensitive personal data

  • (i) Political opinion, religious views
  • (ii) Medical status and private information in medical records, not including blood types
  • (iii) Ethnicity information
  • (iv) Genetic information
  • (v) Biometrics and physical information
  • (vi) Sexual orientation
  • (vii) Criminal records collected and maintained by enforcement agencies
  • (viii) Customer information of credit institutions, foreign bank branches, intermediary payment service providers, other authorized organizations, including customer identification information as prescribed by law, account information, deposit information, information on entrusted assets, transaction information, information about organizations or individuals acting as guarantors at credit institutions, bank branches, intermediary payment service providers
  • (ix) Data on the individual's location determined through positioning services
  • (x) Other personal data that is determined by the law to be unique and needs to remain secure.

2. Personal Data we collect

2.1. Depending on the nature of your interaction with us, we may collect the following personal data:

  • (i) Name/Full Name
  • (ii) Gender
  • (iii) Email address
  • (iv) Phone number and Facsimile number
  • (v) Age or date of birth
  • (vi) Contact address
  • (vii) Education, profession, occupation, job title and staff code
  • (viii) User information such as username, password, user account, and user ID registered for acquiring or given for using our products and services
  • (ix) Information of your organizations (such as full trading name, abbreviated name, license or establishment decision, tax code, registered offices, enterprise registration certificate or equivalent documents which may include personal data of legal representatives and/or investors/owners)
  • (x) Details of the products and services you have purchased, directly or indirectly, from us or which you have enquired about, together with any additional information necessary to deliver those products and services or to respond to your enquiries.
  • (xi) Any additional information relating to you that you provide to us directly through our websites or indirectly through use of our websites or online presence, through our representatives or otherwise.
  • (xii) Your Bank account and/or bank statement which is a sensitive information.

2.2. We may also collect information that is not personal data because it does not identify you or anyone else. For example, we may collect anonymous answers to surveys or aggregated information about how users use our websites.

2.3. Except for stated clearly in this Policy, we do not generally collect sensitive personal data. We may however do so to perform a specific function authorised by a third-party organisation (for example, to perform a business process function that has been outsourced to us by a customer) provided that we will only do so if you have given your consent (either to us or to the third party) and it is reasonably necessary for the functions or activities of the collecting party.

3. How do we collect your personal data

3.1. We collect your personal data directly from you unless it is unreasonable or impracticable to do so. We may collect personal data in several ways including:

  • (i) through your access and use of our websites
  • (ii) emails and phone calls from you
  • (iii) exchange of business cards between you and our employees
  • (iv) during correspondence between you or your organisation and our representatives
  • (v) when you or your organisation submits to us a document containing personal data (including but not limited to emails, contact forms, order forms, contracts, business licenses, statements of work, surveys, service request forms)
  • (vi) automatic collection when you use our products and services (equipment maintenance information, etc.)
  • (vii) automatic collection when you use our systems (log information such as log-in history, browsing history, etc.)

3.2. We may also collect personal data from third parties including:

  • (i) from law enforcement agencies and other government entities.
  • (ii) from agents, distributors, resellers, subcontractors that form part of our sales and/or service network.
  • (iii) from our customers that have outsourced a business process function to us
  • (iv) from our service providers that collect information on our behalf.

4. Purpose of processing your personal data

4.1. We collect, hold, use, or disclose your personal data for the following purposes:

  • (i) To sell, promote and provide products and services to you and/or your organisation
  • (ii) To answer enquiries and provide information or advice about existing and/or new products or services
  • (iii) To respond to communications from you or your organization
  • (iv) To perform data analytics as well to standardise and improve processes across our related affiliates within Fujifilm Group
  • (v) To process and respond to any complaint made by you, including to seek legal or professional advice in relation to your complaint
  • (vi) To register and handle of product warranties
  • (vii) To perform business processing functions including providing personal data to our related affiliates within Fujifilm Group, contractors, service providers or other third parties
  • (viii) To provide you with information that you request (by post, telephone, or email)
  • (ix) To provide you with access to protected areas of our websites
  • (x) To assess and improve the performance and operation of our websites
  • (xi) To help us improve our products and services
  • (xii) For our recruitment process
  • (xiii) To register you in programmes that you wish to join
  • (xiv) To engage with you as a business contact in respect of your role with one of our business partners, suppliers, or customers
  • (xv) To send you additional information on our products and services which we think may be of interest to you
  • (xvi) Sending you information on products and services of our selected business partners which we think may be of interest to you
  • (xvii) To comply with the legal regulations
  • (xviii) To verify your identity to make credit decision for sale related activities, staff training and quality assurance purposes (which may include monitoring or recording calls to our customer support)
  • (xix) For the marketing (including direct marketing), planning, product or service development, quality control and research purposes of us and our contractors and service providers
  • (xx) To update our records and keep your contact details up to date (including updating the records of our contractors)

If you do not wish to provide us with personal data, we will be unable to properly provide you with the products, services, information and/or warranty that you require.

4.2. We may also use your personal data for purposes related to those described above which would reasonably be expected by you.

4.3. We collect personal data about you so that we can perform our business activities and functions and to provide best possible quality of customer service.

5. Processing method of your personal data

We, at all times, has the full authority to decide on the means and methods of handling personal data, information appropriate to the Purposes stated this Policy, including but not limited to physical, written, spoken, and electronic methods. Furthermore, You also agree to allow us and third parties to automatically process your personal data through electronic means (such as software systems and algorithms) for the purpose of assessing, analysing, and predicting user activities, such as habits, preferences, behaviour, trends, capabilities, and other scenarios to continue improving our products and services.

6. The other relevant parties

To fulfill the Purposes, you agree to allow us to share the information and data provided by You with third parties (acting as data processors/third parties) in the following cases (including but not limited to):

  • (i) Our employees and experts for the Purposes stated in this Policy or for the purpose of operating and managing business activities
  • (ii) Other affiliate companies within Fujifilm Group related to the products and services provided to customers. For this, your personal data may be transferred to, processed in, or accessed from one country other than Vietnam (for example Japan, Singapore, Malaysia)
  • (iii) Any third-party involved in part of our business processing functions, including but not limited to:
    • a. Delivery service provider
    • b. Postage service provider
    • c. Debt collection providers
  • (iv) Our authorized service providers to provide services at request of you or your organization
  • (v) Our vendors providing services to us or our business partners, including but not limited to IT service providers, credit assessment agency, marketing agency, marketing platform provider, data analysis service provider, operating or financial lease service provider, law firm
  • (vi) Other third parties which we deem necessary to implement Purposes stated in this Policy

In addition, you also agree to allow the mentioned third parties to process personal data, information (including collecting information on behalf of us). We recognize the value of the information You provide, and We take reasonable measures to protect Your information that We hold.

7. Personal Data Storage and Protection

7.1. To the best of our ability, we implement some key protecting methods including: (a) we limit access to your Personal Data on a “need to know” basis and only for disclosed purposes. Individuals with access to the data are required to maintain the confidentiality of that information; (b) we monitor access to our information technology systems to detect and prevent misuse of Personal Data; (c) we use technological controls over our information systems, such as firewalls, user verification, data encryption, and segregation of roles, systems, and data.

7.2. If you have an account with password which allows you to access certain parts of our websites or any other portal, application, or services we operate/manage, please note that keeping this account and password confidential is also your responsibility. Please make sure you do not share your account and password with anyone else.

8. Undesirable consequences and damage that may occur

We currently have security policies and procedures to protect personal data from loss, misuse, unauthorized alteration, or destruction. However, please note that despite our best efforts, no website, Internet transmission, computer system, wireless connection or any absolute security can be guaranteed against all threats.

9. Data Processing Period

9.1. We will only retain your personal data for as long as we need it to fulfill the Purposes set out in this Policy, unless otherwise prohibited by legal regulations, or until there is a request for deletion, destroy personal data of customer regulated by legal regulation. At the end of the retention period or as we deem appropriate, we may, in our sole discretion and in accordance with the law, take steps to destroy your Personal Data or store such Personal Data in an anonymous form unless otherwise required by legal regulations.

9.2. We may retain personal data for a longer period if necessary to comply with legal regulations and requirements or for other lawful purposes, such as handling requests and complaints, resolving disputes, and responding to requests from regulatory authorities.

10. Transferring personal data abroad

By providing data to us, you agree to the transfer of information outside of Vietnam for the purpose of fulfilling your needs and the data processing Purposes specified in Section 4 of this Policy. Therefore, the customer's personal data may be transferred outside Vietnam.

However, in principle, the countries to which personal data is transferred shall be limited to those countries where personal information is legally protected at the same level as that of Vietnam. In addition, we will conclude and manage a contract for the protection of personal information with the company to which personal information is transferred.

11. Your Rights and Obligations

11.1. As a data subject, you have the following rights related to your personal data:

  • (iii) Right to access
  • (iv) Right to withdraw consent
  • (v) Right to delete or request to delete
  • (vi) Right to restrict data processing

Please also note that these rights may be limited, for example, if fulfilling your request would disclose personal data about another person, or if you ask us to destroy information, we are required to retain under required by law or there are legitimate interests to retain, or your request is restricted by law.

11.2. Your obligations regarding personal data

In addition to the above rights, you, as a data subject, also have obligations under the law such as respecting and protecting personal data of others and providing complete and accurate personal data when consenting to the processing of personal data. We will not be responsible for your violations of current legal regulations on personal data protection as well as this Policy. You agree to indemnify and hold us harmless and liable for any and all non-compliance by you with applicable laws regarding the protection of personal data as well as with this Policy (including but not limited to requirement not impersonating the other when providing personal data to us, and only providing personal data of others to us with consent of data subject).

12. Advertising and Marketing

We will ask for your consent to use your personal data for advertising and marketing purposes. If you do not want us to send you promotional/marketing information, or use your personal data for profiling in connection with advertising/marketing, or send your personal data to third parties for advertising/marketing purposes, you can ask us not to do so, at any time, by:

  • (i) Replying to a promotional/marketing e-mail by clicking on the ‘unsubscribe’ button
  • (ii) Changing privacy settings within an application (if available on the application)
  • (iii) Contacting us
  • (iv) Implementing the opt-out or unsubscribe instructions set out in our relevant communication
  • (v) In other ways according to our instructions from time to time

13. Tracking Technology for Website and Web Services

13.1. Definition

  • (i) "Cookie" is identification information that is transmitted to the person's browser by servers and is preserved on the browser side for effective operations of Web sites.
  • (ii) "Web beacon" is technology to acquire aggregated site visitation statistics of access to the specified Web pages using cookies.
  • (iii) "IP address" is a number that can specify the computer accessing the servers. (User of computer cannot be specified.)

13.2. Use of Cookie, Web Beacon, and IP Address

FUJIFILM Business Innovation may use Cookies, Web beacons, or IP addresses recorded on the Website that is operated by FUJIFILM Business Innovation for the following purposes:

  • (i) To identify the causes of problems arising at Web servers and to resolve these problems,
  • (ii) To improve the contents of Web sites and e-mail,
  • (iii) To customize the contents of Web sites and e-mail for the user's individual interest or purpose,
  • (iv) To use browsing history by the person and the results of questionnaires for marketing by FUJIFILM Business Innovation in the service for membership system where personal information of the person has been registered in advance,
  • (v) To obtain aggregated site visitation statistics whereby the individual person cannot be identified.

You can reject use of Cookies and Web beacons by FUJIFILM Business Innovation by configuring the Internet browsing software (hereinafter referred to as "browser") to reject the acquisition of Cookies.

In this case, however, some restrictions may occur by which some functions such as customization cannot be used.

13.3. Use of Google Analytics

FUJIFILM Business Innovation may use Google Analytics on FUJIFILM Business Innovation sites to grasp how they are used by visitors. Google Analytics gathers access information using to FUJIFILM Business Innovation website without specifying individuals. 13.4. SSL (Secure Sockets Layer)

FUJIFILM Business Innovation will use encryption by SSL (Secure Sockets Layer) or other security technologies to prevent tapping into the communication process by third parties when you provide personal data through FUJIFILM Business Innovation sites.

However, these technologies may not be used in some rare cases because of the person's computer environment, system restriction or other reasons. In these cases, FUJIFILM Business Innovation will display on the Web site that security cannot be ensured in the communication process.

13.5. Google Advertising, HubSpot

Our Websites/Web services may use Google advertising and HubSpot to provide advertisements and information that are considered useful to you.

These companies collect Cookie data from service users and use Web beacons. However, it is not possible to specify individuals from Cookie data and Web beacons.

If you wish to suspend these advertising-related functions, please follow these steps:

Access the following page and turn off ad customization.

13.6. Handling on Websites Linked to the Website

This Policy does not apply to any other websites linked to the Website. For the handling of personal information on any such website, please refer to the personal information protection policy or equivalent policy of the website.

14. Revisions of Privacy Policy

FUJIFILM Business Innovation reserves the right to change, amend or update this Policy. We will post the Policy after the change and specify the date of revision in our website. Please remember to review the Policy occasionally which may have changed from time to time.
